1. Introduction

Welcome to MicroGym ("we," "our," or "us"). By accessing or using our website, mobile application, and any other services provided by MicroGym (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

2. User Accounts

2.1 Registration

To access certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

2.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

2.3 Account Types

We offer different account types for gym administrators, trainers, and clients. The features and capabilities available to you depend on your account type.

3. Service Usage

3.1 License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our Services for your personal or business use, as applicable to your account type.

3.2 Prohibited Uses

You agree not to:

  • Use the Services in any way that violates any applicable laws or regulations
  • Impersonate any person or entity or misrepresent your affiliation with a person or entity
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services
  • Attempt to gain unauthorized access to any portion of the Services or any systems or networks connected to the Services
  • Use any robot, spider, or other automated device to access the Services
  • Introduce any viruses, Trojan horses, worms, or other harmful material to the Services
  • Use the Services to send unsolicited communications
  • Attempt to decipher, decompile, disassemble, or reverse engineer any of the software comprising the Services

3.3 Content

Our Services may allow you to post, upload, or submit content, including text, photos, videos, and comments ("User Content"). You retain ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such User Content for the purpose of providing and improving our Services.

4. Payments and Subscriptions

4.1 Subscription Plans

We offer various subscription plans for gym administrators. The features, fees, and billing cycles associated with each plan are described on our pricing page.

4.2 Payment Terms

By subscribing to one of our plans, you agree to pay all fees associated with your selected plan. We use third-party payment processors, and your use of these services is subject to their terms of service and privacy policies.

4.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing cycle unless canceled before the renewal date. You can cancel your subscription at any time through your account settings or by contacting our support team.

5. Fitness and Health Disclaimer

MicroGym is a platform for fitness professionals and their clients. We are not a healthcare provider, and our Services are not intended to diagnose, treat, cure, or prevent any disease or health condition. Always consult with a healthcare professional before beginning any new exercise program or making significant changes to your fitness routine, especially if you have pre-existing medical conditions.

6. Intellectual Property

All content on our Services, including text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of MicroGym or its content suppliers and is protected by international copyright, trademark, and other intellectual property laws.

7. Termination

We may terminate or suspend your account and access to our Services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL MICROGYM, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE SERVICES.

10. Indemnification

You agree to defend, indemnify, and hold harmless MicroGym, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any conflict of law principles.

12. Changes to Terms

We may revise these Terms from time to time. The most current version will always be posted on our website. By continuing to use the Services after revisions become effective, you agree to be bound by the revised Terms.
